Lifetime tax planning involves structuring your financial assets, gifts, and investments during your lifetime to protect your wealth and minimise eventual Inheritance Tax (IHT) exposure for your beneficiaries. Under current UK tax rules, individuals have a Nil Rate Band (£325,000) and an additional Residence Nil Rate Band (up to £175,000 when leaving a main home to direct descendants). By utilising lifetime exemptions – such as annual gifting allowances, gifts out of surplus income, and transferring assets into trusts – our specialist solicitors help you pass on wealth tax-efficiently while ensuring you retain sufficient income for your own ongoing living and care needs.

Making lifetime gifts can significantly reduce the taxable value of your estate, provided you survive seven years from the date of the gift under Potentially Exempt Transfer (PET) rules. Alternatively, transferring assets or cash into lifetime trusts allows you to place funds beyond your estate for IHT purposes while maintaining legal control over how and when beneficiaries receive capital or income. Our private client team advises on selecting the right trust structures, calculating any immediate lifetime tax charges, and coordinating with independent financial advisors to safeguard family wealth for future generations.

Business owners and agricultural landowners can benefit from valuable statutory reliefs, such as Business Relief (BR) and Agricultural Relief (AR), which can reduce IHT exposure by up to 100% on qualifying assets. However, securing these reliefs requires strict compliance with HMRC rules regarding active trading, holding periods, and operational structures. Our solicitors work alongside your accountants to audit your business assets, draft tax-efficient Wills, and restructure trading or property shareholdings to ensure full qualification for available reliefs without triggering unforeseen Capital Gains Tax liabilities during your lifetime.
