Shared Ownership

Shared Ownership services

Efficient and experienced

Shared ownership is available to first time buyers to get them on the housing ladder. This offers them the opportunity to purchase a percentage of a property in conjunction with a housing association. In return, they will be able to secure a mortgage against the property and will pay rent to the housing association in addition to repaying their mortgage.

The lease drafted by the housing association will require a meticulous review to ensure that you are fully advised on the provisions of the lease and any restrictions it may place on your ownership of the property.

At Ellisons we appreciate the importance of a first home to our clients and we want to ensure that they are happy with it. That’s why we strive to ensure that every buyer knows exactly what they are getting so that they can maximise the use of their new home.

We will also advise you of the annual or monthly rent due under the lease as well as report to you on the mortgage you have taken out (if applicable).

Shared ownership allows buyers to purchase an initial share in a property – usually between 10% and 75% – while paying rent on the remaining portion to a housing association. Because shared ownership involves a specialist lease drafted by the housing association, our conveyancing team meticulously reviews the agreement to explain all provisions, rent terms, and maintenance obligations. We also coordinate with your mortgage lender and the housing association’s legal team to ensure all approvals are secured on schedule.

Staircasing is the process of purchasing extra shares in your shared ownership home over time, allowing you to eventually reach 100% ownership in most cases. To staircase, an independent RICS valuation determines the current market value of your property, which fixes the price for the additional percentage you wish to buy. Our solicitors review the valuation, liaise with the housing association to confirm eligibility, update your lease details, and handle any top-up mortgage borrowing required for completion.

When selling a shared ownership home, the housing association usually holds a nomination period – typically four to eight weeks – giving them first right to find a buyer. If they do not secure a buyer within that timeframe, you can sell your share on the open market through an estate agent. Our conveyancing team guides you through the housing association’s resale procedures, checks lease assignment requirements, and ensures all legal documentation transfers without unnecessary delays.
