Right to Buy

Right to Buy services

Fast and efficient service

When purchasing your property from the local authority or housing association under the Right to Buy scheme, we appreciate that you have already lived in the property for some time; so we know not to hold up the process with endless enquiries that the local authority or housing association will not have the answers to.

We can offer a fast service to people purchasing their property and can advise on any potential legal issues that may arise as the owner of the property.

We can also do this in conjunction with any lenders that may be used and do all of this within the time frame set out by the local authority/housing association.

When purchasing your home from a local authority or housing association under the Right to Buy scheme, you purchase directly from your landlord using a statutory discount. Because you already reside in the property, our conveyancing team avoids raising unnecessary enquiries that the council cannot answer, helping to keep the process moving efficiently. We review your formal Section 125 offer notice, examine title documents, and ensure all legal checks are completed within the strict timeframes set by your landlord.

If you sell your property within five years of completing your Right to Buy purchase, you must repay a percentage of the discount you received, depending on how soon you sell. Additionally, if you decide to sell within ten years, you are legally required to offer the property back to your former landlord or another local social housing provider first under the right of first refusal rules. Our solicitors explain these post-completion obligations clearly so you understand how future plans may impact your discount and property rights.

If you are buying a flat or maisonette, your Right to Buy purchase will be leasehold, requiring careful inspection of service charge estimates, management terms, and future maintenance plans. Our team liaises directly with your mortgage lender to satisfy their specific requirements for former local authority properties and coordinate funds on time. We ensure all mortgage deeds, lease covenants, and HM Land Registry registrations are completed properly to safeguard your financial and legal ownership.
