Experienced Property and Construction Solicitors advising on the true cost of safety

The Building Safety Act 2022 (“the Act”) has introduced significant responsibilities for building owners, landlords, developers, and leaseholders. Our specialist solicitors provide comprehensive support across every stage of ownership, occupation, and dispute resolution for buildings affected by the Act.

We assist clients with all legal issues relating to buying, selling, and remortgaging flats impacted by building safety requirements. This includes:

  • Reviewing building safety documentation, EWS1 forms, Fire Risk Appraisals of External Walls (FRAEWs), and all related reports
  • Advising on how a building affected by the Act could affect lending and marketability Liaising with lenders, managing agents, and sellers’ solicitors to resolve queries and prevent delays
  • Ensuring lease terms are compliant with the Act and identifying any building safety‑related service charge risks
  • Advising leaseholders on protections from costs under the Act and related regulations

We also offer extensive support with issues arising during the construction or occupation of higher‑risk and multi‑occupancy buildings, including:

  • Advising on compliance with the Act’s new duty‑holder regime
  • Guidance for accountable persons and principal accountable persons on their statutory building safety obligations
  • Reviewing and negotiating contractual arrangements relating to construction, remediation, or fire safety works
  • Risk assessments and strategic advice for landlords and developers facing potential liability
  • Claims relating to defective construction, fire safety failures, or breaches of building regulations

Where disputes arise, we are experienced in representing clients in both Tribunal and Court proceedings, including:

  • Applications to the First‑tier Tribunal (FTT) for
    – Remediation Orders (requiring landlords or responsible parties to fix building safety defects)
    – Remediation Contribution Orders (requiring developers, landlords or associated companies to contribute to the cost of remediation)
  • Court claims for Building Liability Orders, extending liability to associated companies where defects have caused loss
  • Recovery actions to challenge unreasonable service charges related to building safety works
  • Defending claims brought by landlords, residents, or regulators
