Ellisons represented a claimant, who was left with serious injuries following a road traffic accident in Chelmsford, Essex. Ellisons assisted them in recovering a six-figure sum in compensation for the injuries sustained. The Claimant was cycling to work when the event unfolded. The claimant was hit by the defendant’s vehicle which was travelling in the opposite direction, when suddenly and without warning, they turned across the claimant’s path and collided into the claimant.

The claimant suffered a moderate to severe head injury together with facial and skull fractures, requiring in-patient care in Addenbrookes Hospital. The claimant further developed post-traumatic epilepsy some time after the accident and suffered from traumatic concussion of the vestibular and auditory systems, as well as Post-Traumatic Stress Disorder (PTSD) and soft tissue injuries to her hip and chest.  The injuries impacted our client’s personal and professional life.

During the case, Ellisons were able to ensure that the defendant’s insurers funded the services of a case management and rehabilitation on a joint basis and then when the insurers no longer would fund the rehabilitation directly, secured significant interim payments which helped the claimant fund their ongoing rehabilitation and case manager and contribute towards their loss of earnings and other expenditure.

Despite the claimant’s committed efforts to engage with the rehabilitation treatment, they will be left with ongoing symptoms which will require ongoing rehabilitation and the settlement has allowed a large sum towards those future expenses.

This was a complex injury which required the opinion of six medical experts, ensuring there was a clear picture as to the prognosis. The claimant felt that an early settlement would assist her recovery and relieve the stress that she felt from bringing an accident claim. Ellisons were able to negotiate with the Defendant’s Solicitors, following Court proceedings being issued but early into the Court procedure, to settle the case prior to the defendant’s Solicitors instructing their own medical experts.
