Ellisons represented a Claimant who was left with multiple serious injuries following a road traffic accident in Essex helping them to recover a 7 figure sum in compensation.
The Claimant was in a stationary queue of traffic on the A130 in Essex, after travelling home after a work event, when the Defendant drove at speed at around 70mph into the stationary queue causing the Claimant’s vehicle to be shunted into a bridge so she became trapped and had to be extracted from the vehicle by the fire and ambulance service.
The Claimant suffered multiple injuries including a mild traumatic brain injury with concussion to the vestibular system, visual disturbance, hearing loss, tinnitus, headaches, dizziness, balance problems, nausea, fatigue, sensitivity to light, short term memory loss and ongoing cognitive difficulties including reduced ability to multitask, reduced concentration and speech difficulties. She also suffered with whiplash symptoms to her neck, severe PTSD and depression.
During the 6 years that the case ran, Ellisons Solicitors were able to secure significant interim payments as the Claimant was unable to work in the same capacity as she did prior to the accident and also arranged an extensive course of rehabilitation treatment with the support of a case manager.
Despite the Claimant’s committed efforts to engage with the rehabilitative treatment and their sheer determination, they will be left with ongoing symptoms which will impact their ability in everyday life. The settlement includes future rehabilitation treatment which will be required.
When the Claimant contacted Ellisons she had contacted a few local Solicitors and they were unable to offer assistance, advising her to pursue the claim herself as they assessed she had suffered from whiplash injuries only. She knew it was more but did not know what. One firm offered to submit the claim through the low value portal system and the Defendant’s insurers offered £7,000. The Claimant knew that she was suffering with more than whiplash symptoms and contacted Ellisons for assistance who took over the claim and were able to secure a 7 figure sum.
The claim proceeded through the court process and was listed for a 7 day trial but the case resolved a few months prior to the trial at a Joint Settlement Meeting.
Bernice Spurgeon, Legal Director in Ellisons Injury Services team said that she is certain that without our involvement the Claimant would not have received this life changing amount of money.
As the Defendant offered such a low amount before Ellisons involvement, we can be almost certain that this is an outcome the claimant would not have achieved without early expert legal advice.
The Claimant was delighted with the outcome and wrote a beautiful letter to Bernice with the following extracts “Thank you does not seem enough for all you have done and the support you have given to me. I remember when I first enquired with you, I had rung around a few firms looking for advice, more local to me and I was offered a cheque for £7,000 from the Defendant. You advised me to reject this. I didn’t know what was wrong with me at that stage as I didn’t even remember hitting my head. From my initial call I could tell that you “got it” and had a great insight into what I was going through from your experience. I remember I said to my husband “I have to go with Bernice at Ellisons”, how blessed was I for making that decision. Over the past 6 years you have been there every step of the way and approached everything with the utmost professionalism, patience and most importantly empathy. When no-one else believed me, you did, you truly listened and heard my voice. Because of your help I am not the same person, I am stronger and I have found my voice. You have left a lasting impact on me, it has been a privilege to have you represent me”.
The Ellisons’ Claimant Personal Injury team is available to guide you through the process of reviewing your claim, securing private medical treatment and rehabilitation wherever needed and to recover the compensation you are entitled to.
