Thomas Randall in Ellisons’ injury services team recently represented an elderly client, who was left with a fractured patella following a slip in a supermarket in Essex, helping them to recover £16,000 in compensation.

As the Claimant walked past the fresh flower stand, she slipped on water and petals which had fallen from the flower stand on to the floor. As a result, the claimant sustained a fracture to her left patella (a break in the front of the knee joint).

The claimant had originally started the claim herself, however, she encountered obstacles in negotiations with the Defendant’s insurers. Upon instruction, Ellisons were involved in a series of negotiations with the Defendant’s solicitors and were able to secure a settlement which was more double than the figure the Defendant’s insurers had previously offered the Claimant.

Medicolegal experts said removal of the metalwork in the Claimant’s knee might relieve ongoing symptoms. Ellisons were able to include the anticipated costs of this surgery in the claim.

The Claimant had made good progress starting the claim herself unrepresented, however, she was unable to secure any serious offers of settlement from the Defendant insurer.
